Successful Change of Use Appeal

This successful change of use appeal concerned the Prior Approval application for a property on Archway Road in Highgate, London.

The building was occupied by offices at ground floor and basement level with residential units on the remaining floors.  The Prior Approval Application was to convert the commercial unit to a single flat. This was under the former Class O of the General Permitted Development Order, subsequently superseded by Class MA.

Initially, the prior Approval application was refused by Haringey Council on the grounds of inadequate natural light for a residential property.

SF Planning, in conjunction with PAPA Architects and Brooke Vincent & Partners submitted a comprehensive assessment to the Planning Inspectorate. This demonstrated and evidenced that all relevant policies and guidance had been considered and met, specifically the BRE Site Layout Planning for Daylight and Sunlight guidance.

During the course of the appeal process the BRE guidance was updated and further minor modification to the internal configuration was required in order to ensure the updated guidance was met.

As a result, the planning inspector agreed with our assessment at appeal. Subject to some secondary conditions unrelated to the initial refusal, our clients can now start work on the conversion.
